There are five degrees of drug possession in Minnesota. For the most part, the actual charge largely depends on the substance and the amount of that substance found in your possession.  In the case of First Degree Drug Possession, the maximum penalty is 30 years in prison and up to $1,000,000 in fines, or both.  For instance:

• A sentence of up to 30 years and $1 million in fines, or both is possible if you have 25 grams or more of Methamphetamine, cocaine, or Heroin
• Any narcotics over 500 grams or more that are not cocaine, heroin, or meth
• One or more mixtures of a total weight of 500 grams or more or equaling 500 or more dosage units containing amphetamine, phencyclidine, or hallucinogen
• 100 kilograms or more of marijuana

In Minnesota Second Degree Drug Possession, the following can yield a penalty as severe as 25 years in prison and fines of up to $500,000, or both:

• 6 grams or more of meth, cocaine, or Heroin
• 50 grams or more of a narcotic other than cocaine, Heroin, or meth
• One or more mixtures of a total weight of 50 grams or more or equaling 100 or more dosage units containing amphetamine, phencyclidine, or hallucinogen
• 50 kilograms or more of marijuana

Third Degree Drug Possession can carry a sentence of up to 20 years in prison and up to $250,000 in fines, or both if in possession of:

• 3 grams or more of meth, cocaine, or Heroin
• 10 grams or more of a narcotic other than cocaine, Heroin, or meth
• 50 or more dosage units of narcotics packaged in dosage units
• 5 or more dosage units of LSD
• 10 kilograms or more of marijuana

Fourth Degree Drug Possession can carry a sentence of up to 15 years and fines up to $100,000, or both when 10 or more dosage units containing a mixture of hallucinogen or phencyclidine are found or the person unlawfully possesses one or more mixtures containing a controlled substance classified in schedule I, II, or III, except marijuana or Tetrahydrocannabinols, with the intent to sell it.

Fifth Degree Drug Possession is the lesser of the penalties and can carry a sentence of up to 5 years and fines up to $10,000, or both.  Under Fifth Degree Possession, it is unlawful for a person to possess one or more mixtures containing a controlled substance classified in schedule I, II, III, or IV, except a small amount of marijuana, which is a petty misdemeanor unless found in a motor vehicle.
